

Following the Prime Ministers announcement on the 22nd September 2020, the Health Protection (Coronavirus, Wearing of Face Coverings in a Relevant Place) (England) Regulations 2020 was amended.
Coming into force on the 24th September 2020.
Regulation 2 amends the regulation on making it compulsory that workers that are listed in Schedule 3 must always wear a face mask.
These include:
- Shops but not including premises providing legal or financial services
- Enclosed shopping centres
- Restaurants and Bars
- Banks
The existing legalisation for an ‘reasonable excuse’ has not been amended for example it will not be necessary for a person that has a mental or physical illness to wear a face mask.
Failing to Comply with the Law
Premises that require to wear face coverings should take the reasonable steps to promote compliance with the law.
If necessary, the Police and Transport for London the enforcement powers, including fines up to £200 for the first offence. The Regulations state that it would be the employee/worker who would be liable for the fine not the employer.
